The 2nd Comprehensive Special Prosecutors’ Team (Special Prosecutor Kwon Chang-young), which investigates the remaining suspicions after the 3rd Special Prosecutors’ Team (Insurrection, Kim Geon-hee, and Chae Hae-byeong), has again begun a search and seizure of the Prosecution’s internal network Epros server in connection with former Prosecutor General Shim Woo-jung’s suspicions of involvement in the December 3 emergency martial law.
The Comprehensive Special Prosecutor’s Team resumed the execution of search and seizure warrants at the Gwangju Center of the National Information Resources Agency in Gwangju Metropolitan City under the on-site direction of Assistant Special Prosecutor Kwon Young-bin from 2 p.m. on the 7th. The comprehensive special prosecution team explained, “We are resuming the execution of the search and seizure warrant that was suspended last night in relation to former President Shim’s charges of engaging in important civil war duties and abuse of power.”
Previously, the comprehensive special prosecution team executed a search and seizure warrant for the Epros server at night on the 24th of last month. At the time, the special prosecutor’s team said, “In order to comply with the procedures under the Criminal Procedure Act, the start time of warrant execution was delayed. As it reached midnight, the warrant execution was stopped and the search and seizure execution team withdrew. We plan to continue executing the warrant in the future.” It is known that this is the first time that a search and seizure warrant has been executed targeting the entire Epros server of the Supreme Prosecutors’ Office.
The comprehensive special prosecution team is investigating former President Shim’s suspicions of involvement in the December 3 martial law emergency and the abandonment of an immediate appeal against the cancellation of former President Yoon Seok-yeol’s arrest. Former Prosecutor General Shim is suspected of having been instructed by former Justice Minister Park Sung-jae to dispatch a prosecutor to the Martial Law Joint Investigation Headquarters (Joint Investigation Headquarters) during the December 3 Martial Law Emergency. It is known that former President Shim spoke on the phone three times with former Minister Park during the martial law period.
In addition, the comprehensive special prosecution team is also investigating how the prosecution decided to give up an immediate appeal against the decision to cancel former President Yoon’s arrest in March of last year. Former President Yoon was arrested and indicted on charges including being the leader of a rebellion, but was released in March of last year when the court decided to cancel his arrest. At the time, the Prosecutor’s Office’s Emergency Martial Law Special Investigation Headquarters expressed the opinion that an immediate appeal should be made and a higher court’s decision should be made, but former President Shim did not file an immediate appeal considering the possibility of unconstitutionality and ordered the release of former President Yoon.
